GENERAL TERMS AND CONDITIONS

These General Terms and Conditions of Use of the lumeelamp.intrade.si online shop are drawn up in accordance with the Consumer Protection Act (ZVPot, Official Gazette of the Republic of Slovenia, No. 98/2004-UPB2, 126/2007, 86/2009, 78/2011), the Electronic Commerce Market Act (ZEPT, Official Gazette of the Republic of Slovenia, No. 96/2009-UPB2), the Code of Obligations (OZ, No. 97/2007-UPB1) and the international codes of conduct for electronic commerce. Please read the privacy policy in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR").
The online shop lumeelamp.intrade.si (hereinafter also referred to as the shop) is operated by the company Intrade d. o. o., Studenška ulica 104, 2000 Maribor, registration number: 5306914000, VAT identification number: SI90301609, which is also a provider of e-commerce services (hereinafter also referred to as the Seller or Intrade d. o. o.).
The General Terms and Conditions of Business govern the operation of the lumeelamp.intrade.si online shop, the rights and obligations of users and the shop, and regulate the business relationship between Intrade and its customers. In addition, they set out the rules relating to the purchase at the Intrade d.o.o. checkout point.

E-COMMERCE SECURITY

The operator of this online shop uses appropriate technological and software tools to protect the transmission and storage of personal data and payments. The online shop is protected by an SSL certificate. Secure Sockets Layer (SSL) is a cryptographic protocol that ensures the security of Internet communications, such as web browsing and e-mail, where the transmission of data of a confidential nature (e.g. personal data and credit card numbers) is required.

AVAILABILITY OF INFORMATION

Intrade d.o.o. undertakes to ensure that the following information is available to customers before they are bound by a contract or offer:
- Information about Intrade d.o.o. (company name and registered office, company registration number),
- contact details for fast and efficient communication with the user (email, phone)
- the key characteristics of the products and the validity of this information,
- Product availability (any product published online must be available within a reasonable period or time),
- Delivery terms (and the method, place and time of delivery),
- Prices must be clearly and unambiguously stated, clearly indicating whether they include taxes, shipping and other charges, and stating the validity of this information,
- the method of payment and delivery or performance and the date of validity of this information,
- the duration of the offer,
- the period within which the contract may be withdrawn, the conditions for withdrawing from the contract (interpretation of the right to withdraw from the contract in accordance with Article 43c of the TFEU; in cases where the consumer does not have the right to withdraw from the contract in accordance with Article 43c of the TFEU, the consumer must be expressly informed of this),
- the complaints procedure, including any relevant information on the contact person or customer service centre.

ORDER

The sales contract between Intrade d.o.o. and the customer is concluded in the online shop lumeelamp.intrade.si when Intrade d.o.o. sends the customer the first e-mail about the status of the order (the so-called Order Confirmation Letter). From that moment on, all prices and other conditions are fixed and binding for Intrade d.o.o. and the customer. The Customer is the person in possession of the information provided at the time of placing the order. No subsequent change of the customer's details is possible.
The Sales Contract (i.e. the first e-mail about the status of the order) is stored electronically on the lumeelamp.intrade.si server.

INVOICING

Intrade d.o.o. will include the printed purchase invoice in the package of ordered items. The invoice will contain a breakdown of the price, all costs associated with the purchase and a notice of the right of withdrawal. It is the Buyer's responsibility to verify the accuracy of the information before placing an order. Any subsequent complaints regarding the correctness of the invoice will be disregarded.

PROTECTION OF PERSONAL DATA

Intrade d.o.o. undertakes to permanently protect all personal data of users in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and ZVOP-1. You can access all detailed information on the processing of personal data on the Personal Preferences tab. Users should be aware that they are obliged to provide all their personal data to the Online Seller and that this data must be true and correct. In addition, Users must notify the Online Seller of any changes to their information. By accepting these Terms and Conditions, Users confirm that the personal data they have provided is correct.

COMPLAINTS AND DISPUTES

Intrade d.o.o. complies with the applicable consumer protection legislation. Intrade d.o.o. undertakes to use its best endeavours to fulfil its obligation to provide an effective complaints handling system. In the event of a problem, customers may contact Intrade Ltd. by telephone (+386 2 460 55 55) or by e-mail (lumeelamp@intrade.si). Complaints should be sent by e-mail to lumeelamp@intrade.si. The complaints procedure is confidential

Intrade d.o.o. is aware that the main characteristic of consumer disputes is the disproportion between the economic value of the claim and the time and costs that can be incurred in resolving the dispute. This is also the main obstacle that prevents consumers from taking their dispute to court. That is why Intrade d.o.o. strives to resolve every dispute amicably.

EXCLUSION OF LIABILITY

The Provider accepts no liability for any consequences of the use of the online shop and its content, including any material or immaterial damage. Users are solely responsible for using the content of the online shop to the best of their ability. Although the online shop is protected by SSL, there is a risk of misuse of the online shop, which is beyond the control of the provider. Therefore, the provider excludes its liability in the event of the transmission of malicious software that may be installed on the device used by the user to access the online shop. The Provider advises Users to educate themselves about the risk of malware infection and to protect their devices against the possible transmission of malware. Despite the Provider's efforts to provide accurate and up-to-date information in the Online Shop, there is a risk that, due to the proliferation of products or rapid changes in information, such information on products, delivery terms, prices or any other information may differ from that provided in the Online Shop or may be incomplete. Users are responsible for verifying the information themselves where there is a suspicion that the information is incorrect or incomplete. We reserve the right to change product information, including images and any other related information, without prior notice.

The Provider shall not be liable for occasional malfunctions of the online shop, for any inaccuracy of the information in the online shop or for any damage caused by the unavailability, use or inability to use the information in the online shop. If the User has ordered a product where incorrect or incomplete information has been displayed, the Provider shall notify the User and give the User the opportunity to withdraw from the purchase. If, after placing the order and before receiving the item, the user discovers that the information provided for the item is incorrect, the user shall report the error to the online shop and the provider shall give the user the opportunity to cancel or modify the order. All product images are for illustrative purposes only. Some product features in the picture do not reflect the actual condition of the products (e.g. the size of the product in the picture). The Provider is not responsible for the content of comments created by users in the online shop. The Provider may reject comments that contain blatant untruths, misleading facts or offensive language towards other users as well as the Provider. The Provider reserves the right to modify the General Terms and Conditions in any way, at any time and for any reason, without prior notice. The Provider reserves the right to change the items available online without prior notice. The Provider shall use its best endeavours to ensure that the information published on the Website is up-to-date and accurate. However, it may happen that the Supplier is unable to deliver an item to a customer because the item is sold out and out of stock. However, the product's characteristics, delivery date or price may change so quickly that the supplier is unable to update the information on the website. In such a case, the supplier shall inform the customer of the changes and give the customer the opportunity to cancel the order or to obtain a replacement of the product ordered. The Provider reserves the right to modify these Terms and Conditions at any time and in any manner, for any reason and without prior notice.

OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES.

Intrade d.o.o. does not recognise any out-of-court consumer dispute resolution provider as competent for the resolution of consumer disputes initiated by consumers under the Act on Out-of-Court Consumer Dispute Resolution in accordance with legal norms.

Intrade d.o.o., as a provider of goods and services offering online shopping in the territory of the Republic of Slovenia, displays on its website a link to the Online Consumer Dispute Resolution Platform (hereinafter: ODRP). The platform is available to consumers here.

This is based on the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC.

FURTHER INFORMATION ON ONLINE SHOPPING

The Buyer is bound by the General Terms and Conditions, which come into force at the time of purchase (placing an online order). The User is informed of the General Terms and Conditions before each order is placed and, by placing an order, confirms that he/she is aware of the General Terms and Conditions.
